Mediation

Helping parties resolve complex commercial and business disputes through a focused, practical, and confidential mediation process
An abstract exploration of dialogue, balance, and the movement toward shared understanding.
Mediation provides parties with an opportunity to resolve disputes without placing the outcome entirely in the hands of a court or arbitrator. As mediator and counsel in mediation, we assist parties in identifying the issues in dispute, and exploring practical options for resolution. Our mediation practice focuses on commercial and business disputes, including contractual disputes, shareholder disputes, partnership disputes, business ownership disputes, construction and engineering disputes, and disputes arising in industrial, manufacturing, transportation, and other commercial sectors. We mediate disputes involving a broad range of business and commercial matters, including commercial contract disputes, breach of contract claims, shareholder and partnership disputes, business ownership, joint venture, business sale and purchase, supplier, customer, and distribution disputes, construction and engineering disputes, manufacturing and supply-chain, transportation and logistics , professional and consulting disputes, claims involving damages, payment, performance, and termination.

Effective mediation requires more than bringing parties together. It requires careful preparation, an understanding of the legal and factual issues, and an appreciation of the commercial interests and relationships involved. Our approach as mediator is designed to help parties move beyond entrenched positions, identify the issues that can realistically be resolved, and work toward a settlement that reflects the circumstances of the dispute. As counsels, we believe mediation can be particularly valuable where parties have an ongoing business relationship or where the cost, uncertainty, and disruption of prolonged litigation make an early resolution desirable. We assist with mediations at different stages of a dispute, including pre-litigation or pre-arbitration mediation, mediation during litigation or arbitration, and mediation of complex commercial disputes. Each mediation is tailored to the nature of the dispute and the needs of the parties. The objective is to provide a structured and constructive environment in which the parties can assess their positions and determine whether a mutually acceptable resolution can be achieved.
